Moms will run to STJ for health insurance coverage
The court will decide whether the list of procedures for air navigation services will remain standard or become comprehensive
If they become taxes, no plan will be required to cover actions not included in the SNA. listing
Activist Andrea Werner announced on social networks that on Wednesday (23) the demonstrators will stand before the Superior Court of Justice of Brasilia against the “Mamata health plans”. She will participate in the demonstration and join other mothers.
The law aims to put pressure on the court so that the list of compulsory acts, examinations and treatments which must be covered by the agreements is not restricted.
On that day, the STJ will decide whether the List of Actions of the ANS (National Agency for Complementary Health), i.e. whether the mandatory coverage list for health plans, remains standard or complete. .
Today, if the treatment is not on the ANS list, the patient can judge the case, and if the judge agrees, the regime is obliged to set up a treatment.
If the list of actions becomes exhaustive, plan operators will not be required to cover actions not on the list of the regulator, which is associated with the Ministry of Health.
According to Andrea, if the court’s decision is to make the role of the ANS taxable, this should mainly affect seriously ill people, for example.
Currently, if you have cancer and your doctor recommends immunotherapy, it is [o procedimento] It’s not on the ANS list, which is old and outdated. But if you go to court, the plan will cover it. If STJ decides that old role is inclusive, that’s it. Andrea explained that blueprints wouldn’t be needed to cover anything on the list.
The trial began in September last year and the rapporteur, Minister Felipe Salumao, voted for the list to be exhaustive, i.e. not to give in to recourse to justice when the plans refuse certain treatments .
